Text and data mining is an automated technique for analyzing large amounts of digital data. It is now indispensable for scientific research, technological innovation, and the development of artificial intelligence. “Yet the regulatory framework governing TDM requires targeted amendments,” says Maryna Manteghi from the University of Turku, who has researched the topic.
“Text and data mining may involve the reproduction of copyrighted works or the extraction of contents of databases protected by the sui generis database right. Therefore, it raises important questions about the lawfulness of accessing and using such content,” Manteghi explains.
In her doctoral dissertation, Manteghi analyzes whether the EU’s current regulation of TDM effectively supports research, innovation, and access to information, while still safeguarding the interests of rightsholders.
“In my research, I identify limitations and restrictions that may hinder large-scale data analysis and increase legal uncertainty,” says Manteghi.
According to Manteghi, the regulatory framework must be readjusted to meet the technological and societal needs of the AI era.
This would enable Europe to create a legal environment that genuinely supports access to information, scientific research, data-driven innovation, and the development of artificial intelligence systems.
The dissertation proposes targeted changes to ensure a more balanced, innovation-friendly, and future-oriented approach.
Manteghi’s research contributes to the ongoing European discussions on copyright, TDM, AI governance, and fundamental rights by combining doctrinal, constitutional, and technological analysis. It offers a clear vision for a more efficient regulatory model for TDM in Europe.
